Anonymity
The
planned Bill will make it an offence, once criminal
investigations have begun, to publish anything identifying
anyone while he/she is still under the age of 18 years old, as
being involved in an offence.
There
are some defences outlined in the explanatory notes. The first
is that at the time of the publication, the publisher did not
know that the matter that breached the restriction was
included in a report.
It is also a defence, where a witness or victim has
been identified, to show that the publisher had no reason to
suspect that a criminal investigation had begun.
Another
defence is for the publisher to show that the report was in
the public interest.
