Testing
products
There is a risk a review of a product or service could
be taken as defamatory because there is the chance
business could be lost. What is important here is to ask
whether any discreditable business conduct is imputed or
whether the person at the centre of the statement is
accused of not being poorly qualified for the particular
trade or profession.
The main defence available
is justification… this means you must be certain that
you have your facts right. The other defence is fair
comment… this allows people to give honest opinions on
matters of public interest.
