Unintentional Defamation

To prove innocence in publishing a defamatory statement, the journalist must show:

  • he/she did not intend the words to refer to the plaintiff;

  • he/she did not know of any circumstances by which the words may refer to the plaintiff;

  • or that the words were not prima facie defamatory.

The publisher must also publish a suitable correction and apology.
