Contempt
in court reporting
One of the
greatest dangers of being in contempt can arise when a jury
has started to try a case.
There are some circumstances in which even a fair and
accurate report of proceedings in open court, though
privileged against an action for defamation, could prejudice a
fair trial and therefore still be found in contempt of court.
A journalist,
adding extraneous information to a report of an ongoing trial
before a jury, may be held in contempt.
Information, which has previously been in the public
domain, is often not exempt from this.
