Family

Family proceedings hear applications for maintenance orders, separation orders, adoption orders, and orders for the maintenance of an illegitimate child.  They also deal with the custody and care cases.

 Under section 71 of the Magistrates' Courts Act 1980 reports must be confined to:

  1. names, addresses, and occupations of parties and witnesses;

  2. the grounds of the application and a concise statement of charges;

submissions on any point of law and the decision of the court on the   submissions; and the decision of the court and any observations made by the court in giving it.

Additionally no particulars must be published leading to the identification of a child under l8 involved in proceedings or his/her school.

In addition to the reporting restrictions on family proceedings in magistrates courts and on children's cases before judges in chambers, a local authority or individual can seek an injunction banning all reporting of the matter, even if the report does not identify the children.
